This is an acceptance of product and/or services for orders placed with A-Dalton Trucking Company, LLC and its DBA, RockNYard Landscape Center. By signing this document, the undersigned is agreeing to pay the amount quoted when the order of said products or services is placed on the schedule. Furthermore, if it is agreed that if payment will be by cash, it will be paid upon delivery and there will be no refunds for the delivery portion even if the product is refused. Products are available for viewing at our landscape center before delivery in order to avoid this issue.
This document also serves as a waiver and release of liability in favor of A-Dalton Trucking Company, LLC and its DBA, RockNYard Landscape Center delivery service and its officers, agents, employees, representatives, sub-contractors, and its parent companies. The undersigned, First Name Last Name, may request that we drop landscape material or product on the property located at or approximately, Delivery Address, Utah. It is understood that the undersigned may or may not own this property or surrounding properties. They may be an acting agent for the owner of the property. If they are not acting as the agent for the owner/s of said property, the undersigned is solely responsible for obtaining necessary permissions from the owner/s to use said property for accessing a different property or using said property as a staging area for the undersigned’s personal needs. The undersigned has had it explained and understands that all equipment and machinery used in the delivery, unloading, placement of said landscape material product is heavy and capable of causing damage to existing landscape, lawn, concrete/asphalt, curb, gutter, sidewalk, etc. We will do our best to dump/place landscape material product where the undersigned is asking. It is known that there could be damage that occurs even when all precautions are taken. The undersigned hereby freely, voluntarily, and without duress accepts full responsibility for damage that occurs and executes this release.
We will be happy to reschedule your delivery free of charge if given at least 48 hours notice. We will do this up to three times. If you need to reschedule under the 48 hour window and there are extenuating circumstances, please call our office to work things out. Anything rescheduled in under 48 hours could be subject to a $50 rescheduling fee. If you need to cancel your delivery, it will be subject to a 2.9% fee transaction fee that has already been paid by us. Each separate cancelled delivery will also be subject to the $50 administration fee.
