This is an acceptance of product and/or services for orders placed with A-Dalton Trucking Company, LLC and its DBA, RockNYard Landscape Center. By signing this document, the undersigned is agreeing to pay the amount quoted when they are offered a day for delivery. The order will then be confirmed when this form and the payment is complete. Furthermore, if it is agreed that if payment will be by cash, the full amount will be paid upon delivery and there will be no refunds even if the product is refused. Products are available for viewing at our landscape center before delivery in order to avoid this issue.
This document also serves as a waiver and release of liability in favor of A-Dalton Trucking Company, LLC and its DBA, RockNYard Landscape Center delivery service and its officers, agents, employees, representatives, sub-contractors, and its parent companies. The undersigned, First Name Last Name, may request that we drop landscape material or product on the property located at or approximately, Delivery Address, Utah. It is understood that the undersigned may or may not own this property or surrounding properties. They may be an acting agent for the owner of the property. If they are not acting as the agent for the owner/s of said property, the undersigned is solely responsible for obtaining necessary permissions from the owner/s to use said property for accessing a different property or using said property as a staging area for the undersigned’s personal needs. This includes obtaining the permissions, whenever necessary, to drop in the street at the curb. The undersigned is reading this form and has had time to have it explained, been able to ask questions and understands that all equipment and machinery used in the delivery, unloading, placement of said landscape material product is heavy and capable of causing damage to existing landscape, lawn, concrete/asphalt, curb, gutter, sidewalk, etc. We will do our best to dump/place landscape material product where the undersigned is asking. It is known that there could be damage that occurs even when all precautions are taken. The undersigned hereby freely, voluntarily, and without duress accepts full responsibility for damage that occurs and executes this release.
We will be happy to reschedule your delivery free of charge if given at least 48 hours notice. We will do this up to three times. If you need to reschedule under the 48 hour window and there are extenuating circumstances, please call our office. Please keep in mind that once placed on schedule, we have been holding/reserving that time slot for you. Holding/reserving your time slot will cause us to turn away other customers asking for that delivery slot. If we are not given sufficient time to fill that delivery slot, we are turning away other work to hold your slot. Therefore, anything rescheduled in between 48 hours and 24 hours of your delivery will be subject to a $50 rescheduling fee. If you reschedule the delivery in under 24 hours of your delivery, each delivery is subject to the $50 administration fee plus a 10% restocking fee. If you need to cancel your delivery with 48 hours notice, it will be subject to a 3.5% credit/debit/Venmo transaction fee (where applicable) that has already been paid by us and each separate cancelled delivery will be subject to the $50 administration fee. If you cancel your delivery within 24 hours of your scheduled time, it can be very complicated depending on how close we are to the actual delivery. It may be subject to but not limited to a 3.5% credit/debit/Venmo transaction fee, 50% restocking fee, and delivery fee. Furthermore, if you have ordered a specialty rock as in palletized rock that has been unpackaged and loaded into the truck, the entire order is non-refundable.
