This is an acceptance of product and/or services for orders placed with Rock N Yard LLC. By signing this document, the undersigned is agreeing to pay the amount quoted when the order of said products or services is placed on the schedule. Furthermore, if it is agreed that if payment will be by cash, the full amount will be paid upon delivery of materials or completion of services, and there will be no refunds even if the product is refused. Products are available for viewing at our landscape center before delivery in order to avoid this issue.
This document also serves as a waiver and release of liability in favor of Rock N Yard LLC delivery and landscape services and its officers, agents, employees, representatives, sub-contractors, and its parent companies. The undersigned, First Name Last Name, (From now on referred to as ‘Customer’) may request that we provide landscaping services on the property located at or approximately, Delivery Address.
1. Acceptance of Estimate & Payment Terms
Upon acceptance of the provided estimate, the customer agrees to the scope of work described. An invoice will be issued, which may be paid by cash, credit card, or Venmo.
- Projects under $1,000
- For projects with a total cost of less than $1,000, 100% payment is required upfront before the project is scheduled.
- Projects over $1,000
- For projects exceeding $1,000, a 50% deposit is required to schedule the project. The remaining balance is due upon project completion.
2. Cancellation Policy
- Projects under $1,000
- If the customer cancels a project under $1,000 after payment, the cancellation fee will be $250 or 50% of the payment total, whichever is greater.
- Projects over $1,000
- For cancellations of projects over $1,000, $500 of the deposit is non-refundable. The remaining balance of the deposit will be returned within 7 business days of cancellation.
3. Rescheduling & Delays
- Contractor’s Right to Reschedule
- Rock N Yard reserves the right to reschedule any project due to weather conditions or material supply issues. Both parties acknowledge that reasonable delays due to inclement weather are expected and will not be considered a failure of performance by the Contractor.
- Customer’s Right to Reschedule
- The customer has the right to reschedule the project with at least 5 business days’ notice without incurring any fee. If the project is rescheduled with less than 5 business days’ notice, a fee of $50 per day less than the 5-day notice period will apply, with a maximum rescheduling fee of $250.
4. Liability and Damage Waiver
- Heavy Equipment Use
- The customer acknowledges that heavy equipment may be used during the project and that this equipment is capable of causing damage to surfaces such as driveways, lawns, pavers, concrete/asphalt, curbs, or sidewalks. The customer accepts these risks and agrees not to hold Rock N Yard responsible for repairing such damage unless it is caused by negligence.
- Incidental Damage to Property
- The customer releases Rock N Yard from liability for incidental damage to the property caused during normal project operations, including damage to lawns, hardscapes, or other existing features. If damage is caused by negligence, Rock N Yard will provide a repair estimate.
- Staging Areas and Permissions
- The customer is responsible for obtaining any necessary permissions to use surrounding properties for staging or accessing the job site. Rock N Yard is not liable for any damage to neighboring properties used for such purposes.
5. Project Completion & Final Payment
Upon completion of the project, Rock N Yard will leave the jobsite in a “broom-swept” condition. Final payment from the customer signifies that the work has been completed to the customer’s satisfaction, and no further obligations are required from the Contractor. By making this payment, the customer acknowledges that all work has been completed according to industry standards.
6. Warranties
Rock N Yard offers no warranties beyond those implied by law. We are not responsible for the replacement or repair of any materials or plants that fail due to the customer’s failure to properly maintain them.
7. Change Orders
Any changes to the scope of work during the project will require a change order. A new estimate will be provided, and acceptance of this estimate will be considered a signed agreement to pay for the additional work.
8. Property Lines
The customer is responsible for determining property lines before work begins. If there is a dispute regarding property boundaries, Rock N Yard reserves the right to delay work in the disputed area until the matter is resolved.
9. Insurance
Rock N Yard LLC is fully licensed and insured as S330 landscape contractors in the state of Utah. Workers’ compensation insurance covers all employees, and general liability insurance is maintained. Certificates of insurance are available upon request.
